PASSENGER RIGHTS NOTICES UNDER CAB 101

Long Delay Notice

This notice is issued in accordance with Thailand's Regulation of the Civil Aviation Board No. 101 -- Measures to Protect Passenger Rights on Domestic and International Scheduled Flights ("CAB 101"). It informs you of your entitlements if your flight is delayed by more than two (2) hours.

Eligibility Criteria

You are eligible for the rights listed below if:

  • Your flight is delayed by more than two (2) hours.
  • The departure airport is in Thailand.
  • The flight is operated by Kuwait Airways.
  • You hold a confirmed reservation on a public fare.
  • You are not excluded from boarding due to safety, security, health, or documentation reasons.
  • You have not already received compensation under another legal scheme.

I. Assistance and Benefits

1. Food & beverages appropriate to waiting time
2. Communication Facilities
3. Hotel accommodation & transport (if overnight stay required)
4. Proper Ventilation, Cabin Temp, Lavatory Facilities, Medical Assistance (In case of Tarmac Delay)
5. Allow passengers to disembark
6. Reimburse/Travel Voucher if travel not continued
7. Re-routing to final/nearby destination (with ground transport if applicable)

II. Compensation

For Kuwait Airways delays over five (5) hours:

>10 hrs 1,501–3,500 km THB 3,500
>10 hrs >3,500 km THB 4,500

Note: Kuwait Airways will provide Travel Voucher for the compensation. Extraordinary circumstances (e.g., severe weather, air traffic control decisions) are exempt from compensation.

Denied Boarding Notice

This notice explains your rights under CAB 101 when you are involuntarily denied boarding due to overbooking.

Eligibility Criteria

You are eligible if:

  • You are denied boarding involuntarily/your flight is cancelled.
  • Your flight departs from Thailand and is operated by Kuwait Airways.
  • You hold a valid confirmed booking.
  • You are not excluded from boarding for safety, health, or document issues.
  • You have not already received compensation under another legal scheme.

I. Re-routing or Reimbursement

  • Option A -- Re-routing: Kuwait Airways will rebook you to your final or nearby destination, subject to availability, including ground transport if necessary.
  • Option B -- Reimbursement: Full reimbursement for the unused segment(s) of your journey. Reimbursement will be provided through Kuwait Airways Voucher.

II. Assistance

  • Communication access (calls, emails).
  • If re-routed: food, beverages, overnight accommodation if needed, and airport transfers.

III. Compensation

Exemptions from compensation:

  • Cancellation due to extraordinary events beyond airline control.
  • Notice of cancellation given ≥ 7 days before departure.
  • Notice < 7 days with alternate flight arriving within 3 hours of original.

Involuntary Downgrade Notice

This notice informs you of your rights under CAB 101 when downgraded to a lower class of service.

Eligibility Criteria

You are eligible if:

  • You are involuntarily downgraded on a Kuwait Airways flight departing from Thailand.
  • You hold a confirmed reservation.
  • You are not excluded from travel for legal or security reasons.
  • You have not received benefits under another regulation.

I. Reimbursement Options

  • Option A -- Proportional Reimbursement of Fare Paid
    Flight Distance Reimbursement
    ≤ 1,500 km 30% of airfare
    1,501–3,500 km 50% of airfare
    >3,500 km 75% of airfare
  • Option B -- Kuwait Airways Options Voucher
    • Travel Voucher in lieu of monetary refund.

Notice to Passengers Traveling to Thailand

​Effective 01st May, 2025, all foreign passengers must complete the Thailand Arrival Card (TDAC) before entering the country. Register online up to 3 days before travel. A QR code confirmation will be sent by email and must be shown at immigration. Passengers without TDAC will be asked to complete it before immigration clearance.
